Abstract |
Inspections raidare an important part of state
environmental supervision due to the fact that the
majority of environmental offenses can only be
detected in this way. However, current legislation
regulates not enough, creating the possibility of
abuse by officials of state control on the one hand,
and reduces its effectiveness — on the other. In
particular, the practice of bypassing the
requirements of the Federal Law «On protection of
rights of legal entities and individual
entrepreneurs in the exercise of state control (supervision)
and municipal control» of December 26, 2008 by
substitution checks raid inspections. So urgent is
the delineation of inspections raid and checks. On
the basis of the study the author offers criteria
for distinguishing the reasons and purpose of checks
and inspections raid.Also it sets out its position
on the control measures that constitute the raid
inspections |
